1Acceptance of Terms
By accessing or using Nour-Elm (the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy.
If you are accessing on behalf of an organisation (e.g. a mosque), you confirm that you are authorised to bind that organisation to these Terms.
2Platform Access & Eligibility
Nour-Elm is a B2B software platform designed exclusively for licensed mosque organisations offering structured Islamic education programmes in the Netherlands and other jurisdictions.
- Access is granted only to registered mosque organisations and their authorised staff
- Each mosque receives an isolated tenant environment; cross-tenant access is strictly prohibited
- Administrative accounts may only be created by the mosque's designated system administrator
- Users must be at least 18 years old to hold administrator accounts
3Permitted Use
Nour-Elm may be used solely for lawful educational management purposes. Permitted activities include:
- Managing student enrolment, attendance, and progress records
- Administering teacher and class schedules
- Generating educational reports and analytics
- Communicating with parents and guardians regarding educational matters
4User Accounts & Responsibilities
Each user is responsible for:
- Maintaining the confidentiality of their login credentials
- All activity conducted under their account
- Ensuring that student and parent data entered is accurate and up to date
- Reporting any suspected unauthorised access immediately to Nour-Elm support
- VOG (Certificate of Good Conduct) compliance for all teaching staff where required by Dutch law
Nour-Elm is not liable for losses arising from failure to protect account credentials.
5Intellectual Property
All rights in the Platform — including design, user interface, source code, branding, text, and documentation — are owned exclusively by Nour-Elm and/or its technology partner DeepSynergy.io.
- No portion of the Platform may be copied, reproduced, distributed, or derived without written permission
- The Nour-Elm name, logo, and "نور العلم" wordmark are trademarks of Nour-Elm
- User-submitted data (student records, attendance logs) remains the property of the mosque
6Data & Privacy
Nour-Elm processes personal data as a data processor on behalf of mosques (the data controllers). Full details of how data is handled are set out in our Privacy Policy and GDPR page.
- A Data Processing Agreement (DPA) is provided to all subscribing mosques
- Data is stored exclusively within the EEA
- Each mosque's data is fully isolated (no shared data pools)
7Subscription & Payment
Access to Nour-Elm is subject to an active subscription agreement signed separately. Key terms:
- Subscriptions are invoiced monthly or annually as agreed
- Non-payment may result in suspension of access after a grace period of 14 days
- No refunds are issued for partial billing periods unless agreed in writing
- All prices are exclusive of Dutch BTW (VAT) unless stated otherwise
- Trial Period & Auto-Downgrade (Personal Accounts). Personal accounts on a trial subscription receive 30 days of access with 100 daily AI inferences. At the end of the trial period, the account automatically converts to the Free tier (100 daily inferences aggregate, permanent). No action is required; this conversion is automatic and completes at midnight UTC on day 30.
- Fair Use Policy & Quota Limits. Free-tier and trial-tier accounts are subject to usage quotas: a maximum of 100 aggregate AI inferences per calendar day (UTC). These limits apply across all AI features combined. Accounts consistently exceeding fair-use limits may receive warnings. After 3 documented violations, Nour-Elm reserves the right to temporarily suspend AI access for that account (typically 24 hours) to prevent resource exhaustion. Institutional (mosque and school) subscription tiers operate under separate service-level agreements with custom quotas determined at sign-up. Premium personal accounts include 200 daily inferences with the same quota enforcement.
8Limitation of Liability
To the maximum extent permitted by Dutch law:
- Nour-Elm provides the Platform on an "as is" and "as available" basis without warranties of any kind
- Nour-Elm is not liable for indirect, consequential, or incidental damages arising from use of the Platform
- Total aggregate liability of Nour-Elm in any 12-month period is limited to the subscription fees paid during that period
- Nour-Elm is not responsible for data loss caused by user error or unauthorised access resulting from failure to secure credentials
9Termination
Either party may terminate the subscription by providing 30 days written notice. Nour-Elm may immediately suspend or terminate access in the event of:
- Material breach of these Terms that is not remedied within 14 days of notice
- Illegal activity or misuse of the Platform
- Non-payment beyond the grace period
Upon termination, the mosque may request an export of all their data in a standard format (CSV). Data will be permanently deleted from Nour-Elm servers within 60 days of termination.
10Governing Law & Disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.
Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a minimum of 30 days.
11Changes to These Terms
Nour-Elm reserves the right to update these Terms at any time. Changes will be communicated by email to the registered mosque administrator at least 14 days before taking effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms.
